16.وَشَرَطَ لِلْمُتَوَلِّي أَنْ يُعْطِيَ كُلَّ ذِي حَقٍّ حَقَّهُ وَيُوصِلَ إِلَى المُسْتَحِقِّ مُسْتَحَقَّهُ مِنْ غَيْرِ بَخْسٍ وَنَقْصٍ وَلَوْ مِنْ تَمْرَةٍ بِشِقْصٍ، مَا دَامَ الدَّخْلُ لِلْخَرْجِ وَافِيًَا وَالأَصْلُ فِي الفَرْعِ كَافِيًَا، وَإِنْ دَخَلَ نُقْصَانٌ فِي الدَّخْلِ وَانْحِطَاطٌ فِي الأَصْلِ بِحَادِثٍ مِنْ حَوَادِثِ الزَّمَنِ وَطَارِقٍ مِنْ طَوَارِقِ الفِتْنَِ، يُدْخَلُ الكَسْرُ فِي جَمِيعِ المَصَارِفِ، وَأَنْ يَعْرِضَ مُحَاسَبَتَهُ فِي رَاسِ كُلِّ ثَلاثِ سِنِينَ عَلَى مَنْ يَكُونُ حَاكِمَا ثَمَنَهُ، فَيُحَاسِبُهُ عَلَى النَّقِيرِ وَالقِطْمِيرِ وَيَسْأَلُهُ عَلَى القَلِيلِ وَالكَثِيرِ وَيَتَفَحَّصُ عَلَى الزِّيَادَةِ وَالنُّقْصَانِ وَالاِرْتِفَاعِ وَالاِنْحِطَاطِ وَالنَّفْعِ وَالخُسْرَانِ وَيَنْظُرُ فِي أَحْوَالِ الذِّمَمِ غَثِّهِمْ وَسَمِينِهِمْ، فَقِيرِهِمْ وَغَنِيِّهِمْ وَمُعْسِرِهِمْ وَمُوسِرِهِمْ وَيَكْشِفُ مِن أَحْوَالِ المُتَوَلِّي هَلْ رَاعَى الشَّرَائِطَ المَذْكُورَةَ المُعْتَبَرَةَ وَأَدَّى خِدْمَتَهُ المَسْطُورَةَ الْمُقَرَّرَةَ، فَإِنْ ظَهَرَ أَمَانَتُهُ وَاسْتِقَامَتُهُ وَاتَّضَحَ سَعْيُهُ وَكِفَايَتُهُ فَبِهَا وَنِعْمَتْ وَبَرِئَتْ ذِمَّتُهُ وَسَلِمَتْ، وَأَمَّا إِنْ تَبَيَّنَ خِيَانَتُهُ وَإِهْمَالُهُ أَوْ وَضَحَ تَقْصِيرُهُ وَإِخْلالُهُ فَيُعْزَلُ عَنْ التَّوْلِيَةِ وَيُنْصَبُ غَيْرُهُ مَكَانَهُ ثُمَّ يُضَمَّنُ مَا يَرَى أَهْلُ الشَّرْعِ ضَمَانَهُ عَنْ مَالِ الوَقْفِ الَّذِي يَتَوَجَّهُ عَلَيْهِ شَرْعًَا، أَصْلًا كَانَ أَوْ فَرْعًَا بِتَقْصِيرٍ عَنْهُ أَوْ إِخْلالٍ بِشَرْطٍ مِنْ شَرَايِطِهِ أَوْ عُذْرٍ أَوْ إِهْمَالٍ بِشَيْءٍ مِنْ ضَوَابِطِهِ، وَيُرَاعَى هَذَا الأُسْلُوبُ فِي جَمِيعِ الزَّمَانِ مَا دَارَ النَّيِّرَانِ وَتَوَاتَرَ الْمَلَوَانِ. ... 16. It is the mutawalli's duty to provide all the rights to those who are entitled to have them. Also, those who deserve something of the waqf shall be given what they deserve without omission or decrease, even if it is a piece of a fig as long as the income may cover expenditures and as long as the capital is sufficient for expenses. Should it be in due time for the reason of time events or intrigues that the income and the capital suffer a decrease, all expenses shall be reduced. The mutawalli is also obliged at the beginning of every three years to submit to the qadi - judge his financial report. The qadi - judge ought to review the mutawalli's report in all details and to inspect as to where it was spent small and where big money as well as to the fact of the surplus and deficit, increase and decrease, benefit and harm of the waqf.
