12 وَأَنْ يَكُونَ فِي المَدْرَسَةِ الَّتِي يُرِيدُ ابْتِنَائَهَا وَتَشْيِيدَهَا وِإِعْلائَهَا وَوَقْفَهَا لِلَّذِينَ يُحَصِّلُونَ العِلْمَ وَيُكَمِّلُونَ النَّفْسَ مِن الطُّلاَّبِ وَالعِبَادِ وَيَشْتَغِلُونَ بِالعُلُومِ العَقْلِيَّةِ وَالنَّقْلِيَّةِ مِنْ بَيْنِ العِبَادِ عَالِمٌ فَاضِلٌ كَامِلٌ نِحْرِيرٌ، كَاشِفُ أَسْتَارِ الحَقَائِقِ بِالتَّقْرِيرِ وَالتَّحْرِيرِ، جَامٌِ بِالفُرُوعِ وَالأُصُولِ، حَاوِي بِالمَعْقُولِ وَالمَنْقُولِ، يُدَرِّسُ بِهِمْ دُرُوسَ التَّفْسِيرِ وَالحَدِيثِ وَالأَحْكَامِ وَالأُصُولِ وَالمَعَانِي وَالبَيَانِ وَالكَلامِ وَمَنْ سَايَرَهَا أَيْضًَا حَسْبَ مَا يَقْتَضِيهِ العُرْفُ وَالمَقَامُ، لا يَفُوتُ دُرُوسَهُمْ إلاَّ بِعُذْرٍ شَرْعِيٍّ، وَلا هُمْ يَفُوتُونَهُ إلاَّ بِوَجْهٍ مَرْعِيٍّ فِيهِ أَيَّامُ التَّعْطِيلِ وَالتَّحْصِيلِ بِمَا فِي العَادَةِ رِعَايَتُهُمَا لا حَاجَةَ إِلَى التَّفْصِيلِ، وَيُفْتِي الأَنَامَ فِيمَا يَسْتَفْتُونَهُ مِن المَسَائِلِ الشَّرْعِيَّةِ بِأَقْوَى المَذَاهِبِ وَالأَقْوَالِ بِالنَّقْلِ وَالأَخْذِ مِنْ كُتُبِ الفَتَاوَى فِي كُلِّ الأَحْوَالِ، شَرْطًَا يَنْضَمُّ إِلَيْهِ نَظَارَتُهُ الحِسِّيَّةُ لِلأَوْقَافِ فِي جَمِيعِ الأَزْمَانِ وَعِنَايَتُهُ بِِهَا فِي كُلِّ الآوَانِ وَالأَحْيَانِ. ... 12. In the madrasa, which the waqif wants to build, establish, erect and devote to those who shall obtain knowledge and improve morality from among the students and common people, and to those who shall be occupied with rational and traditional knowledge, there shall be the one of them, who shall be knowledgeable, virtuous, excellent and competent, who shall uncover the secrets of realities by verbal and written words, who shall combine particular and universal as well as comprehend rational and traditional knowledge. He shall teach Qur'anic exegesis, Islamic tradition, the basics of Shari?ah law, the theory of law, Arabic stylistics, speculative theology as well as all other things that the custom (or time) and the place require. He shall not miss any lecture except for the reason that is justifiable by the Shari?ah, and the students shall not miss the lectures either except by permission. Both the time of vacation and the time of lecturing shall be as it is accustomed and thus there is no need to explain that in details. He shall issue fatwa-answers to people who shall ask fatwa-questions in accordance to the strongest madhhab-schools of law and opinions, using in each and every case the books of fatwas. Also, it is ordained that his monitoring of the waqft shall be for ever and his care of it shall be at all times and in all circumstances.

13.وَمُعِيدٌ يُرَاعِي وَظِيفَةَ الإِعَادَةِ عَلَى مَا هُوَ المُقَرَّرُ فِي القَانُونِ وَالعَادَةِ، وَبَوَّابٌ يُقِيمُ خَدَمَاتِ الْمَدْرَسَةِ مِنْ كُتُبِهَا وَمُحَافَظَةِ أَسْبَابِهَا وَفَتْحِ بَابِهَا وَإِغْلاقِهَا: _ وَعَيَّنَ لِلْمُتَوَلِّي مَا عُيِّنَ مِنْ غَيْرِ الأَوْقَافِ الْمَذْكُورَةِ؛ _ وَلِلنَّاظِرِ الجَابِي مَا تَعَيَّنَ مِنْهُ أَيْضَا؛ _ وَعَيَّنَ لِلْمُدَرِّسِ كُلَّ يَوْمٍ خَمْسِينَ دِرْهَمًَا مِنَ الأَوْقَافِ المَزْبُورَةِ؛ _ وَلِلْمُعِيدِ أَرْبَعَةَ دَرَاهِمَ؛ _ وَلِكُلِّ وَاحِدٍ مِن الطَّلَبَةِ كُلَّ يَوْمٍ دِرْهَمَيْنِ؛ _ وَلِلْبَوَّابِ أَيْضًَا دِرْهَمَينِ. وَعَيَّنَ البَاقِي قَلِيلًا كَانَ أَو كَثِيرًَا لِتَكْمِيلِ المَبْلَغِ المَزْبُورِ إِنْ انْتُقِصَ لِحَادِثَةٍ مِنْ طَوَارِقِ الْحُدْثَانِ ثُمَّ لِيُخْرَجَ مَا يُنْتَقَصُ مِنْ أَطْعِمَةِ عِمَارَةِ الوَاقِفِ المَذْكُورِ، تَقَبَّلَ اللهُ حَسَنَاتِهِ المَلِكُ الشَّكُورُ، ثُمَّ لِمَرَمَّةِ عَامَّةِ أَوْقَافِهِ، فَيُحْفَظَ مَعَ سَائِرِ الزَّوَايِدِ مِنْ سَايِرِ الأَوْقَافِ بِيَدِ المُتَوَلِّي بِمَعْرِفَةِ النَّاظِرَيْنِ المَذْكُورَيْنِ وَيُصْرَفَ إِلَى المصَارِفِ المَرْقُومَةِ وَقْتَ الاِحْتِيَاجِ. ... 13.
