6 وَشَرَطَ أَنْ يُسْتَغَلَّ المَنَازِلُ وَالأَمْلاكُ المَزْبُورَةُ عَلَى الوَجْهِ الشَّرْعِيِّ وَالأُسْلُوبِ المَرْعِيِّ وَأَنْ يُبْنَى بِأَرْبَعِمِائَةِ أَلفِ دِرهَمٍ مِن المَبْلَغِ المَسْفُورِ مَدْرَسَةٌ شَرِيفَةٌ رَفِيعَةُ البُنْيَانِ جَلِيلَةُ القَدْرِ بَيْنَ الخَوَّاصِّ وَالأَعْيَانِ فِي أَرْضِهِ المُحَازِيَةِ لِبَابِ الجَامِعِ العَالِي الَّذِي بَنَاهُ وَأَعْلاهُ الوَاقِفُ الوَالِي، المُسْتَغْنِيَةِ عَن التَّحْدِيدِ وَتبْيِينِهَا لاشْتِهَارِهَا بِانْتِسَابِهَا إِلَى وَقْفِهَا، مُشْتَمِلَةً بِاثْنَيْ عَشَرَ حُجْرَةً يَسْكُنُهُا القَوَابِلُ مِن الطَّلَبَةِ دُونَ الفَوَاسِقِ مِن الجَهَلَةِ، بِبِنَاءٍ مَشَيَّدٍ وَأُسْلُوبٍ مُؤَيَّدٍ، كَمَا هُوَ مَرْسُومٌ فِي مَدَارِسِ الوُزَرَاءِ وَالأُمَرَاءِ جَزَاهُمُ اللهُ ثَوَابَ الاِسْتِفَادَةِ وَإِفَادَةِ العُلَمَاءِ الفُضَلاءِ. ... 6. Then he conditioned that the aforementioned houses and properties be rented according to the Shari?ah rules and customary regulations. Also, out of the aforementioned amount a descent madrasa shall be built for the amount of 400.000 dirham, the building of which shall be great and its reputation shall be respectable among the honorable and noble men. It shall be built at the location facing the door of the glorious Mosque which was built and erected by this waqif and the wali and needs neither to be defined nor explained as it is known as the property of this waqif. The madrasah shall consist of 12 rooms where only the hardworking students shall reside. There shall be no place for corrupt and ignorant students. (The building of the madrasa) shall be great, and the curriculum of it shall be permanent and similar to the madrasas of the viziers and princes, May Allah reward them for their contributions that benefit all who serve others and are virtuous.

7 وَمَا يَفْضَلُ مِن خَرْجِ البِنَاءِ المَزْبُورِ يُبْتَاعُ بِهِ الكُتُبُ المُعْتَبَرَةُ وَتُسْتَعْمَلُ فِي المَدْرَسَةِ المَذْكُورَةِ، يَسْتَفِيدُ بِهَا مَنْ يُطَالِعُهَا مِن المُسْتَفِيدِينَ وَمَنْ يَسْتَنْسِخُهَا مِن الْمُحَصِّلِينَ. ... 7. Then, from the remainder of the expenditure for the madrasa building, books shall be bought and shall be used in the madrasah. These books shall be at the disposal of those who wish to read them and to those who would like to copy them among those who wish to obtain knowledge.

8 وَيُسْتَرْبَحُ البَاقِي مِن المَبْلَغِ المَسْفُورِ وَهُوَ ثَلاثُمِائَةِ أَلْفِ دِرْهَمٍ بِالرَّهْنِ القَوِيِّ وَالكَفِيلِ الْمِلِّيِّ عَلَى حِسابٍيَكُونُ رِبْحُ كُلِّ عَشْرَةِ دَرَاهِمَ مِنهُ فِي كُلِّ عَامٍ دِرهَمًا فَيُعَامَلُ عَلَى نَهْجٍ شَرْعِيٍّ أَنِيقٍ وَطَرِيقٍ مَرْضِيٍّ وَثِيقٍ، لا يَشُوبُ فِيهِ شَائِبَةُ الرِّبَا، وَلا يَتَطَرَّقُ إِلَيهِ الضَّيَاعُ، وَأَنْ يُعَامَلَ بَأَهْلِ التُّجَّارِ وَالصُّنَّاعِ وَالزُّرَّاعِ مِن أَرْبَابِ المِلَلِ المَعْرُوفِينَ بِاليَسَارِ وَالمُتَمَوِّلِينَ ذَوِي الاِقْتِدَارِ، يُرَى عَلَيْهِمْ آثَارُ الأَمَانَةِ سِيَّمَا الاِسْتِقَامَةِ وَالصِّيَانَةِ، وَيَكُونُ شُهْرَتُهُمْ بَينَ النَّاسِ بِحُسْنِ المُعَامَلَةِ لا بِالْكَذِبِ وَالتَّسْوِيفِ وَالمُمَاطَلَةِ، وَلا يُدْفَعُ إِلَى الأُمَرَاءِ وَالوُلاةِ وَالمُدَرِّسِينَ وَالقُضَاةِ وَلا إِلَى الجُنْدِيِّينَ وَسَائِرِ الجُيُوشِ وَأَرْبَابِ التِّيمَارِ وَالفََسَقَةِ وَالفُجَّارِ وَلا إِلى الأَعْوِنَةِ وَأَهْلِ الدُّيُونِ وَمَمَالِيكِ السُّلْطَانِ وَلا إِلَى مَنْ نِيَّتُهُم بِالتَّزْوِيرِ والطَّمَعِ مِنْ أَيِّ فِرْقَةٍ كَانَ. ... 8. The remaining of the aforementioned amount of 300.000 dirham, shall be invested in such a way that there be a strong reason and an insured endorsement for the income of one dirham per 10 dirham each year.
